Privacy Notice
I. RESPONSIBLE FOR THE PROTECTION OF YOUR PERSONAL DATA AT THE ELDERLY HOME "LAS MARAVILLAS DE CUERNAVACA".
EL asilo "Las Maravillas de Cuernavaca" and the senior adults, A.C., located at Gonzalo de Sandoval 111 Lomas de Cortés, Cuernavaca, Morelos, C.P. 62240, is responsible for the collection and processing of your personal data as established by articles 2° and 3° section XIV of the Federal Law on the Protection of Personal Data Held by Private Individuals (LFPDPPP) and 47 of its Regulations.
II. PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA. "Las Maravillas de Cuernavaca and the senior adults, A.C.," ensures the strictest confidentiality in the collection and processing of the personal data of the residents and relatives gathered at its various branches. These personal data will be processed in accordance with the LFPDPPP.
In accordance with articles 15 and 16 of the LFPDPPP, 26, 27, and 28 of the Law's Regulation, we inform you that your general, financial, proprietary, and sensitive personal data will be personally collected through printed means to be used by "La Universidad La Salle Cuernavaca" for the following purposes:
Provide support and lodging required by you and your relatives at our branches.
Conduct registration procedures, psychological and health evaluations at various branches.
Information and communication between different sections of the institution, managers, caregivers, nurses, Geriatric doctor, nutritionist, psychologists, and psychiatrists, for example in cases of psychological, medical support, and emergencies.
Offer information from other institutions with which "Las Maravillas de Cuernavaca and the senior adults" collaborate to comprehensively support our residents.
III. CONSENT FOR "LAS MARAVILLAS DE CUERNAVACA" TO PROCESS SENSITIVE, FINANCIAL, AND PROPERTY DATA. In compliance with articles 8 and 9 of the LFPDPPP, you are informed that to collect and process your sensitive, financial, or property data, as indicated in section II of this Notice, it is necessary to have your express consent. In those cases where information classified in any of these categories is required, you will be asked for authorization to process this data using the appropriate format. You can at any time revoke the consent granted to the educational institution for the processing of your personal information in cases specified by the LFPDPPP.
IV. TRANSFER OF PERSONAL DATA. "Las Maravillas de Cuernavaca" may transfer your general personal data to other branches.
V. USE OF IMAGES BY THE RETIREMENT HOME "LAS MARAVILLAS DE CUERNAVACA". Moreover, to document and communicate to all members of the Geriatric community that are part of "Las Maravillas de Cuernavaca," information about resident life and events celebrated during the year, such as masses, outings, and celebrations, "Las Maravillas de Cuernavaca" may use, print, reproduce, and publish images of residents, relatives, or employees in printed, electronic (blogs, private social networks of the institution, website), internal newsletters in all their forms, interpretations or executions, editions, phonograms or video grams, and broadcasts for the stated purpose, using external providers if necessary.
Likewise, "Las Maravillas de Cuernavaca" may take or receive photos of employees and residents for administrative or medical files, as well as work purposes, to identify them and allow them access to the facilities of "Las Maravillas de Cuernavaca" at different branches.
Outside of these cases, "Las Maravillas de Cuernavaca" will not reveal any images about school life.
In those cases where the Institution intends to use the image of residents, collaborators, or other community members for marketing or advertising purposes, the resident's or their family's consent will be necessary and will be collected by the university before using the image.
VI. REVOCATION OF CONSENT TO GERIATRIC AND EXERCISE OF RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION, AND OPPOSITION TO THE ELDERLY HOME "LAS MARAVILLAS DE CUERNAVACA". As indicated in the LFPDPPP, you may request access, rectification, cancellation (when legally applicable), or oppose the use of personal data provided to those responsible, or revoke the consent granted. Your request will be addressed by our Privacy Officer: Gabriela Carvallo Mariel.
To exercise your Access, Rectification, Cancellation, and Opposition rights, as well as to revoke your consent, you must follow the following procedure:
1. Send an email to gabriela.carvallo@maravillasdecuernavaca.com, stating your full name, the legal or commercial relationship you have with the Institution (i.e., whether you are an employee, resident, relative, visitor, etc.), and the type of right you wish to exercise.
2. Fill out the ARCO request form that will be sent to you, precisely identifying the data for which you request access, rectification, cancellation, or opposition, or those for which you wish to revoke your consent, attaching one of the identification documents indicated in the form to prove your identity or the personality with which you make the request. Once this form is filled out, it must be sent to the email address indicated in the previous section, and relevant documents can be attached to the request in question. For rectification requests, the holder must precisely indicate the modification to be made, attaching the documentation that justifies their request.
3. Once your request is received, you will be sent an acknowledgment receipt with the file number (file) and the corresponding reception date. If your request does not meet legal requirements, you will be required to remedy your request within ten days, within five business days following its receipt. If you do not, it will be considered not presented.
4. If your request is sent on Saturday, Sunday, or a non-working day, it may be received the next working day you send it.
5. Your request will be answered via email within twenty working days from the acknowledgment receipt date. This period may be extended by an additional twenty days when there are reasons to justify it; this situation will be notified to the owner as established by article 97 of the LFPDPPP Regulation.
6. If your request is procedurally in accordance with the LFPDPPP and other current regulations, access will be granted, and your data will be rectified or canceled, your opposition right will be made effective, or consent will be considered revoked within fifteen days following the response to your request. This period may be extended by an additional fifteen days when there are reasons to justify it; this situation will be notified to the owner as established by article 97 of the LFPDPPP Regulation.
In all cases where your request is procedurally in terms of articles 32, 33, 34, and 35 of the LFPDPPP, the delivery of personal data will be free through the email address that the data owner indicates for such purposes. If you require the information to be delivered differently, you must only cover the justified shipping costs and/or the reproduction.
